TAXATION OF COSTS AND GROUND RENT APPLICATIONS ONLY
Further to the statement of the President of the Circuit Court Published on 8 May 2020, and due to the current provisions of the Health Act 1947 (Section 31A -Temporary Restrictions) (Covid-19) Regulations 2020, and further to the Notices published 27 May 2020 for the re-listing of Landlord and Tenant (Ground Rent) Acts applications and 8th June 2020 for the re-listing of Taxation of Costs, the time for complying with those notices having now expired and those notices are hereby replaced and the following applies while restrictions due to Covid 19 remain in place:-
Those cases where the Questionnaire was returned completed have been assigned hearing dates and times and the moving party has been notified.
The other cases now stand adjourned generally with liberty to re-enter. In order to obtain a new hearing date a Notice of Re- Entry is required together with a completed Questionnaire.
For any new applications for a hearing date for Taxation of Costs the same must be accompanied with a completed Questionnaire.
For any new applications for a hearing date for Ground Rent Applications, the same must be accompanied with a completed Questionnaire.
Please Further Note: - In order for hearing cases to be dealt with efficiently and on a timely basis and in accordance with Government and HSE guidelines and policies, parties will have to ensure that: -
1. Copies of documents to be relied upon have been disclosed to the opposing side, in advance of the Hearing.
and
2. Copies are available for the County Registrar and will be lodged via post or drop box facilities in the Office, in advance of the Hearing.
3 .All original exhibits are filed and all affidavits are stamped and filed in the Circuit Court Office.
Documents must be lodged in the Circuit Court Office not later than 72 hours prior to the hearing date with the record number and hearing date clearly marked on the documents.
